Terms of Service

Your music stays yours. Submit only work you have the right to submit. One account per person, and never rig a vote. HitOrMiss is free, run by one person, and provided as-is. Break the rules and you lose your account.

By using hitormiss.co — with an account or as a guest — you agree to these terms, to the community rules, and to the privacy policy. The community rules are part of this agreement. If you don’t agree, don’t use the site.

You must be at least 13 years old. You may hold one account, and one only — a second account used to influence voting costs you every account you own, permanently.

You’re responsible for what happens under your account and for keeping your password to yourself. Tell us at littleaiprojects@gmail.com if you think someone else has access to it.

You keep every right you have in the tracks you upload. HitOrMiss claims no ownership and will never license, sell, distribute or train anything on your music.

To actually run a competition we need permission to do the obvious things: store your file, stream it to listeners and show its title and artwork on the site, on your profile, and in the competition it was entered into. So by submitting a track you grant us a non-exclusive, worldwide, royalty-free licence to host and display it for those purposes only. That licence ends when the file is deleted or you remove the submission.

Submitting a track is you confirming that the version you uploaded is yours to enter. Remixes, covers and sample-based work are welcome, but clearing whatever needs clearing is on you, not on us or the host.

You must not upload or post:

• Someone else’s work passed off as your own.
• Anything that infringes a copyright, trademark or other right you don’t hold.
• Abuse, harassment, slurs or hateful content. Blunt feedback is the point of this site; cruelty isn’t.
• Anything illegal, or anything that impersonates another person.
• Malware, or content designed to break the site.

If you hold rights in something posted here without permission, email littleaiprojects@gmail.com with the details and we’ll take it down.

A hit has to mean someone actually liked the track, so this is the part we enforce hardest. You may not vote on your own submission, use extra accounts to vote, or organise other people to hit your track or miss everyone else’s — that counts even when the accounts belong to real people.

We record where votes come from and check for coordination. Votes we find were manipulated are voided and the competition is recalculated, even if it already finished and even if that changes who won. Coordinated manipulation means a permanent ban on every account involved. Think we got it wrong? Email littleaiprojects@gmail.com and we’ll look again.

Anyone can host. If you do, you set the rules, genres, timeline and any prize, and you’re responsible for running it as advertised — including actually delivering a prize you announced. HitOrMiss provides the software; we’re not a party to your competition and we don’t hold, escrow or guarantee prizes.

Hosting also means you can see and email the addresses of people who entered. Use them for messages about that competition and nothing else. No marketing, no mailing list, no passing them on. Misusing participant emails will get your account suspended.

If your competition involves a prize, making sure it’s legal where you and your entrants are is your responsibility.

Audio files are automatically deleted 14 days after a competition’s voting period ends. Titles, votes and results remain so the history still makes sense. Keep your own copies — HitOrMiss is not storage or a backup service, and we’re not liable for files that are gone.

We may remove content, close a competition, or suspend or delete an account that breaks these terms or the community rules. Serious cases — vote manipulation above all — result in a permanent ban without warning. You can appeal to littleaiprojects@gmail.com.

You can delete your own account at any time from settings.

HitOrMiss is free for hosts and participants. There are no fees to enter. If that ever changes we’ll give notice before it does, and it won’t apply retroactively.

HitOrMiss is a side project maintained by one person. It’s provided as is, without warranties of any kind. We don’t promise it will be available, bug-free, or that data won’t be lost, and we may change or discontinue features at any time.

To the fullest extent the law allows, we’re not liable for indirect or consequential losses, lost opportunities, lost music, or anything arising from another user’s conduct or a host’s failure to deliver a prize. Nothing here limits liability that can’t be limited by law.

If someone brings a claim against us because of what you uploaded or how you used the site — an uncleared sample, an infringing track, a competition you ran — that’s on you to cover, to the extent the law allows.

These terms may change. The date at the top changes with them, and significant changes will be flagged on the site. Continuing to use HitOrMiss after a change means you accept it.

These terms are governed by the laws of the jurisdiction in which HitOrMiss is operated. Before starting anything formal, email littleaiprojects@gmail.com — nearly everything gets sorted that way.
